Pavemyway has the right but not the obligation to resolve disputes between users of Pavemyway.

Client'stored content on Pavemyway/partners'servers

During the client's routine use of the Service, client may store,accumulate content,scripts,objects,items,currency,equipment, or other value or status indicators that reside as data on Pavemyway,its partners,or providers servers .
THESE DATA, AND ANY OTHER DATA, ACCOUNT HISTORY AND ACCOUNT NAMES RESIDING ON THE INDEMNITEES SERVERS, MAY BE DELETED, ALTERED, MOVED OR TRANSFERRED AT ANY TIME FOR ANY REASON IN PAVEMYWAY'S SOLE DISCRETION.

Account Cancellation/Termination of service.

Cancellation are initiated by you,the client,sending us an email expressing your wish to cancel. Cancellation will be confirmed by replying to a confirmation request email to the email account through which you first signed up and logging to your account to cancel.
Once in the "cancel" page, you will have to fill in certain information(including Last 4 credit card numbers) ,then hit go(to search database) to verify a match for the info, if match found,you will be given the option to cancel your account(s).Cancellation will take effect within 48 hours.All related subscription account data will be permanently deleted and your account will cease to function.

Refund policy

Memberships and Subscriptions

There will be no refunds for any unused time on a subscription or any prepaid fees for any portion of the Service.
However, if you have paid for a period in advance you will be allowed to use the remaining time,granting you did not violate the terms of service Agreement and the service is still made available to you on the "as available" basis.
In the event that Pavemyway suspends or terminates your Account or this Agreement for a reason or no reason, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees, any content or data associated with your Account, or for anything else.
Suspension/termination may affect your other accounts and your affiliates'accounts in the event of your breaching of the terms of service or in case of payment delinquency(As deemed so at our sole and absolute discretion)

Pavemyway uses a highly professional,renowned,secure and internationally recognized as trustworthy and reliable third party as our payment gateway processor.
Credit card information or other financial information that you supply upon a purchase is not usually known to the website.
Such sensitive information is handled by shopping cart services supporting merchant service companies like Visa and Master Card in a securely encrypted way.
In such a case where these payment processing companies do provide information to the website,they do not provide complete credit card numbers.
In those instances,the Pavemyway.com website does not keep the details of your payment information.
Pavemyway will not be liable for any losses you may suffer as a result of unauthorised access and use by a third party of the credit card information you transmit when you order from the Site.
It is your responsibility to ensure the security of your own system password and credit card details to avoid its unauthorised use.

Prices and payment terms

Certain aspects of the Service are provided on a paid plan basis. These plans fees are described on the Website, and in the event you elect to use paid aspects of the Service, you agree to the pricing, payment and billing policies applicable to such fees, posted or linked at the relevant section of the site.
Pavemyway does not currently invoice on credit nor does it perform credit check. All payments are expected to be prepaid.After the end of your prepaid commitment period, as applicable, your service Package Payment Plan will continue at the then- applicable rate for your selected subscription term.
When ordering,You must select a payment method to pay for your fees for any Service basic or Premium and for all purchases made from Pavemyway services and Products. You must give us accurate billing and payment information and keep this information up-to-date through the "My Account" area or otherwise contact us for that matter.
You understand and agree that You are responsible for all charges incurred under your account,including fees, surcharges and purchases made by you or anyone on your account.
You authorize Pavemyway to charge your designated payment method for these charges. If Pavemyway does not receive payment from your designated payment method, you agree to pay all amounts due upon demand by Pavemyway or its operators.
Every time you use an Pavemyway's paid service or Product, you reaffirm that:

  • Pavemyway (or its designated vendor acting as Pavemyway's billing agent) is authorized to charge your designated payment method.
  • Pavemyway may submit charges incurred under your account for payment.
  • Fees charged for subscription plans are non-refundable and due in advance on a prepaid basis.
  • There is no refund or discount for downgrades,but charges are adjusted in future billing periods.

Paid accounts are non-transferable and non-refundable.Once a username for the account(service) is chosen and paid for, that client generally retains it until the account is deleted, whether by Pavemyway or the client.
The price actually charged for a specific Service will be the price in effect at the time the Service is requested.
We do not implement any Money back guarantee or early termination fee policies of any term length under any justification.

Service and Pricing adjustment

Pavemyway may add new services for additional fees and charges, or proactively amend structue,payment method,fees,terms or promotions for existing services, at any time in its sole discretion.
Such promotional and/or discounted pricing ("Promotional Pricing") may have additional limitations and restrictions as part of the terms of such offer, including for a limited time, while supplies last, and/or be bundled with additional accessories.
In the event that Pavemyway's pricing increases, we will honor the price set during order placement or special billing agreement for the entire period of your current selected subscription term.
For instance,If your account is invoiced/prepaid on a quarterly, semi-annually or yearly basis, you will receive your set monthly recurring charge until the end of the current payment period. This does not include new orders under the same name and/or location or new orders associated with a service relocation, nor orders for service changes that may be required if the desired service is not available due to technical or other reasons.
Accounts will be invoiced(invoice summary) solely via email unless a physical paper invoice is requested for an additional charge per invoice.
With regards to site memberships and web hosting services,Pavemyway charges for its service continuously regardless of whether or not you are using it because we continue to maintain your account requirements. This is also true of delinquent accounts.
Customers are required to pay and Pavemyway is required to bill and collect all applicable local, state and federal taxes imposed on Pavemyway customers by the various taxing authorities.Pavemyway passes all taxes it collects on to the appropriate taxing authority.

Late and Payment Failure

If Client fails to pay any sums when due, Client acknowledges and agrees that Pavemyway may demand payment of the balance owed in full, with accrued interest at the monthly rate of 1.5% of the outstanding balance.
Pavemyway may, at its sole discretion, suspend performance of any further Services until such time as all payments due are paid.
In the event Client fails to make payment for any Services when due or the event Pavemyway takes any action to enforce its rights, Client agrees to pay all costs of collection, including reasonable attorneys' fees, which are incurred by Pavemyway or its agents, whether or not a lawsuit is filed. In the event of litigation to enforce the terms herein, the prevailing party will be entitled to recover from the other party its costs and fees, including reasonable attorneys' fees.

Force Majeure

Missed Deadlines and Delays

Pavemyway is not responsible for delays caused by internet connection outages,phone service outages,power outages,manpower shortages,transport mode failures,action of government or civil authority,theft, vandalism,fire,water,civil disorder,accidents,and other causes beyond our control.
Pavemyway also assumes no responsibility for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Pavemyway expected delivery date is not guaranteed, although Pavemyway rarely misses a due date. An order may arrive and a service may be performed late due to unforeseen delays in delivery service, the breakdown of equipment, strikes, illnesses, etc.

Entire Agreement

These Terms of Service constitute the entire agreement between you,the client and Pavemyway.com with respect to the use of this service.

Violation of Terms of Service

Should you violate these terms of service or any other rights of Pavemyway,Pavemyway reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, terminating any service and all user accounts.
Pavemyway failure to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision or of any other rights or provisions in these Terms of Service.

COMPLIANCE WITH LAWS

You will comply with all applicable laws, statutes, ordinances and regulations in connection with your use of Pavemyway website.

MISCELLANEOUS

If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These Terms of Use sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

Governing Law

All legal issues arising from or related to the use of this site/subsites and site/subsites-related service(s) shall be construed in accordance with the laws of the Ontario province of Canada without regard to conflicts of law principles.
